Document: Decree of the President of the Republic of Azerbaijan on making amenments to the Decree of the President of the Republic of Azerbaijan "On state regulation of the use of subsoil" dated October 23, 2003 No. 975 (“Decree”)

Commentary: According to the "Rules on conducting auctions (biddings and competitions) for putting the subsoil into use" (referred to as the "Rules") approved by the Decree, auctions for subsoil use are organized by the State Agency for Utilization of Mineral Resources under the Ministry of Ecology and Natural Resources of the Republic of Azerbaijan. These auctions are conducted in the form of either bidding or competition.
With the exception of cases involving direct negotiations for subsoil use, the primary methods for putting the subsoil into use are bidding or competition. Non-ore deposits within the territory of the Republic of Azerbaijan are utilized through bidding, while ore deposits are allocated through a competitive process.
The competition for subsoil utilization can be open or closed, whereas the bidding is conducted in an open manner. Legal entities and individuals from the Republic of Azerbaijan, as well as foreign entities, are eligible to participate in the open competition and bidding, regardless of ownership type or organizational-legal structure. Closed competitions are limited to invited participants only.
The Rules also outline the provision of information about the auction, the submission and acceptance of participation applications, the functioning of the auction commission, and the procedures for conducting biddings and competitions.
An additional change includes the exclusive use of open bidding for non-ore deposits, aimed at enhancing transparency in the process. Furthermore, the responsibility for organizing auctions has been consolidated under a single entity: the State Agency for the Use of Mineral Resources under the Ministry of Ecology and Natural Resources, streamlining the process further.
Hence, the implementation of these Rules is expected to establish a more effective mechanism for allocating subsoil use rights and fostering a fair and competitive environment in this sector.
The Decree came into force on July 18, 2023.

Şərh: Fərmanla təsdiq edilmiş “Yer təkinin istifadəyə verilməsi üzrə hərracların (auksion və müsabiqələrin) keçirilməsi Qaydaları”na ("Qaydalar") əsasən, yer təkinin istifadəyə verilməsi üzrə hərraclar artıq Azərbaycan Respublikası Ekologiya və Təbii Sərvətlər Nazirliyinin tabeliyində Dövlət Mineral Xammal Ehtiyatlarından İstifadə Agentliyi tərəfindən təşkil edilir, auksion və ya müsabiqə formasında keçirilir.
Birbaşa danışıqlar yolu ilə istifadəyə verilmə halları istisna olmaqla, yer təki istifadəyə auksion və ya müsabiqə vasitəsilə verilir. Azərbaycan Respublikası ərazisində yerləşən qeyri-filiz yataqları auksion, filiz yataqları isə müsabiqə qaydasında istifadəyə verilir.
Yer təkinin istifadəyə verilməsi ilə bağlı keçirilən müsabiqə açıq və ya qapalı, auksion isə açıq elan olunur. Açıq müsabiqədə və auksionda mülkiyyət növündən və təşkilati-hüquqi formasından asılı olmayaraq, Azərbaycan Respublikasının, habelə xarici ölkələrin hüquqi və fiziki şəxsləri iştirak edə bilərlər. Qapalı müsabiqədə yalnız bu məqsəd üçün dəvət olunan şəxslər iştirak edirlər.
Qaydalarda hərrac haqqında məlumat verilməsi, hərracda iştirak üçün ərizələrin verilməsi və qəbul edilməsi, hərrac komissiyasının fəaliyyətinin təşkili, auksion və müsabiqənin keçirilməsi qaydaları da nəzərdə tutulmuşdur.
Qeyri-filiz yataqlarının yalnız auksion yolu ilə istifadəyə verilməsi kimi yeni əlavənin prosesə daha çox şəffaflıq gətirəcəyi gözlənilir. Əlavə olaraq, hərracın təşkili əvvəlki qaydalara uyğun olaraq iki qurumun əvəzinə bir quruma - Ekologiya və Təbii Sərvətlər Nazirliyinin tabeliyində Dövlət Mineral Xammal Ehtiyatlarından İstifadə Agentliyinə həvalə edilməsi də prosesin sadələşdirilməsinə töhfə verməlidir.
Beləliklə, Qaydaların tətbiqinin yerin təkindən istifadə hüquqlarının verilməsi ilə bağlı daha səmərəli mexanizm yaradacağı və bu sahədə ədalətli rəqabət mühitinin inkişafına təkan verəcəyi gözlənilir.
