      Receivership proceedings

      On July 4, 2025, by Order of the Ontario Superior Court of Justice (the "Receivership Order"), KPMG Inc. was appointed receiver (the "Receiver") of BECC Construction Inc., Dali Drywall Ltd., 2737566 Ontario Inc., and Massive Devcon Corporation (collectively, the “Debtors”), pursuant to section 243(1) of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3, as amended and section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, as amended.

      On October 2, 2025 the Ontario Superior Court of Justice granted an order approving a sale transaction contemplated by the asset purchase agreement between the Receiver and 16239005 Canada Ltd. The sale transaction closed pursuant to the terms of the asset purchase agreement.

      Information for Former Employees regarding the Wage Earner Protection Program (“WEPP”)

      WEPP provides payment up to a maximum amount for eligible unpaid wages, vacation pay, termination pay and severance pay to former employees of an employer who is in receivership. The Receiver will be making an application to WEPP on behalf of all eligible former employees of the Debtors. The Receiver will mail to all eligible former employees certain additional information regarding WEPP by September 22, 2025.
