On January 17, 2019, Gymboree, Inc. filed a Notice of Intention to Make a Proposal under subsection 50.4(1) of the Bankruptcy and Insolvency Act (the “BIA”). KPMG Inc. ("KPMG") consented to act as trustee under the proposal.
Please note that effective April 12, 2019 Gymboree, Inc. changed its name to 616900 N.B. Inc. (“616900”) and all documents and correspondence hereinafter issued will refer to 616900.
The deadline for 616900 to file a proposal was April 12, 2019 and the date has passed without a proposal being filed. As such, 616900 is deemed to have made an assignment in bankruptcy pursuant to section 50.4(8)(b) of the BIA (the “Bankruptcy Proceedings”) effective April 13, 2019. KPMG is acting as the trustee-in-bankruptcy (the “Trustee”).
Creditors of 616900 (formerly known as Gymboree, Inc.) will be mailed a Notice of Bankruptcy and Information on the First Meeting of Creditors in due course.

Information for Former Employees regarding the Wage Earner Protection Program (“WEPP”)
WEPP provides payment up to a maximum amount for eligible unpaid wages, vacation pay, termination pay and severance pay to former employees of an employer who is bankrupt. The Trustee will be making an application to WEPP on behalf of all former employees of 616900 (formerly known as Gymboree, Inc.). The Trustee will mail to all former employees certain additional information regarding WEPP within 45 days of the date of the bankruptcy, being May 28, 2019. Update: The Trustee has received an extension from WEPP. Employees should now expect to receive information from the Trustee regarding WEPP by June 28, 2019.
A set of frequently asked questions regarding WEPP will be provided to all former employees as part of the notice to creditors which will be mailed out within 5 business days of the date of the bankruptcy.
