      On June 23, 2012, Lindor Inc. (“Lindor”) filed a notice of intention to file a proposal pursuant to Section 50(4) of the Bankruptcy and Insolvency Act. KPMG is the Trustee acting in re: the proposal of Lindor.

      On July 9, 2012, Lindor filed a petition for an extension of delay in virtue of Section 50(4) paragraph 09 of the Bankruptcy and Insolvency Act. Said petition was granted by Me Pierre Pellerin, registrar, thereby having the effect of prolonging the delay in which to file the proposal by an additional 45 days, until August 23, 2012.

      On August 23, 2012, Lindor has lodged a proposal under the Bankruptcy and Insolvency Act. A general meeting of the creditors was held on the 11th day of September, at 10:00 am, at the Office of the Superintendent of Bankruptcy, 5 Place Ville-Marie, 8th Floor in Montréal, Québec.

      On September 11, 2012, further to a request from the creditors to postpone the general meeting of the creditors, a second general meeting of the creditors was held on the 5th day of October 2012, at 10:00 am, at the Office of the Superintendent of Bankruptcy, 5 Place Ville-Marie, 8th floor, in Montreal, Quebec.

      Following the refusal of the creditors to accept the proposal of Lindor Inc., it was deemed to have filed an assignment on the 5th day of October 2012, and KPMG Inc. was appointed as trustee of the estate of the bankrupt by the official receiver and confirmed by the creditors.

      The first meeting of the creditors of the bankrupt was held on the 5th day of October 2012, at 12:00 pm, at the office of the Superintendent of Bankruptcy, at 5 Place Ville-Marie, 8th floor, Montreal, Quebec.
