      Generally, our intent is to collect only the personal information that is provided voluntarily by online visitors so that we can offer information and/or services to those individuals or offer information about employment opportunities. Please review this privacy statement ("Privacy Statement") to learn more about how we collect, use, share and protect the personal information that we have obtained.

      There are specific privacy statements that include additional information on KPMG's processing of personal data with regard to a specific theme or webpage hosted by KPMG. Examples are the privacy statement in the context of recruitment and in the context of our preference center, marketing contacts, personalized content, events and with regard to our services which can be found via the following links:

      KPMG carries out various activities in the field of marketing, sales and relationship management. For example, we maintain a CRM (customer relationship management) system with contact profiles, we send newsletters and other mailings (direct messaging), we conduct market research and marketing campaigns, we organise (web) events and conferences, and we have an alumni network and alumni programme.

      These activities are aimed at achieving KPMG’s own business objectives. When carrying out marketing activities, we always comply with the law and the rules that apply to the protection of personal data. We will never sell your personal data to data traders or provide it to third parties for their direct marketing activities.

      In this privacy statement you can read more about our use of personal data for our activities in the field of marketing, sales and relationship management (hereinafter collectively referred to as ‘marketing’ or ‘marketing activities’).

      This privacy statement should be read in conjunction with our general KPMG Online Privacy Statement, which contains additional information about our use of personal data, such as in relation to your rights and the sharing of personal data with third parties. 

      Why do we use personal data?

      In the context of our marketing activities and activities which support our marketing activities, we use personal data of various people, such as people who register for our (web) events, alumni, people who work for (prospective) clients or suppliers, students and professionals. We i.a. use this personal data for the following purposes and activities:

      • Drawing up, recording, completing and maintaining contact profiles of our (business) contacts in our CRM system.
      • Managing our relationships and maintaining personal contact with (prospective) clients and other business contacts.
      • Automatically sending personalised direct messages (direct messaging) about various topics (chosen by you), such as white papers, newsletters, articles and other KPMG publications, information about our services and invitations to (web) events.
      • Running marketing campaigns, for example via business-to-business telemarketing, (online) advertising campaigns or social media campaigns, to promote and sell our services, products or other matters such as recruiting new colleagues.
      • Organising events for (prospective) clients and other (business) contacts such as KPMG alumni or partners with whom we work, and all associated activities, such as sending invitations, information, course materials registering attendance and/or providing participation certificates and evaluation forms.
      • The KPMG Alumni programme for which former KPMG employees can register and for which several activities are organised, such as events and network meetings.
      • Conducting (market) research to measure, analyse and improve (the effectiveness of) our marketing activities and interactions.
      • Analysing website use and website visits and personalising website content.
      • Internal reporting on our marketing activities so that various departments involved have more insight into the effectiveness and options for improvement of our marketing activities.
      • Preparation of internal information reports of (prospective) clients for (future) marketing activities.
      • Developing our products and services, such as identifying client needs and exploring potentially interesting prospective clients.
      • Publishing and reporting on marketing activities, such as sharing articles and videos of marketing activities on our website or through social media.
      • Maintaining, securing, managing and using (IT) systems, websites and applications that we use for our marketing activities. 

      What types of personal data do we process?

      In connection with our marketing activities, various types of personal data may be used, including:

      • (Business) contact details such as name, gender, title, (business) address, (business) email address and telephone number and social media names and accounts;
      • Professional data such as job (title), educational background and data about the organisation where you work or have worked;
      • Data concerning the use of our websites and direct messages such as information about clicking on a link or advertisement, visits to our website, logging in or filling in a digital form and opening our direct messages or links or advertisements incorporated in them. Such (behavioural) data is generally collected using techniques such as cookies and pixels;
      • Technical data such as IP address, device type and device identification numbers, web browser and operating system used, and automatically assigned codes such as unique identifiers, Barcodes and/or QR-codes and time codes (time stamps). We collect data such as this i.a. by using techniques such as cookies, pixels and similar techniques;
      • Account data (login data) such as user name, email address and password for e.g. KPMG tools, KPMG portals or protected web environments. An example is the portal where you can choose and customise your preferences for direct messages.
      • Visual and audio materials such as photos, video or audio recordings we make during physical events or during digital events such as a webinar;
      • Preferences, interests, consent and/or objections such as consents for direct messages, telemarketing or the use of certain cookies, selected language preferences and preferences for direct messages, your geographical location (based on IP address) and (derived) information on interests, based on, for example, your use of our websites, direct messages or your registrations for certain events. We also keep records of whether you have objected to or withdrawn your consent to certain marketing activities to ensure that your personal data is not used improperly;
      • Other (personal) data you provide us with, depending on the marketing activity and related activities, we use other personal data, such as your responses to surveys, studies, assessments or evaluations, questions you ask us and evaluation forms you complete in connection with an event.

      We have no intention of collecting or using special categories of personal data, such as information about race or ethnic origin, political opinions, religious and other beliefs, trade union membership, information about sexual orientation or health data. In the course of our marketing activities, however, we may obtain information from which sensitive personal data may be derived, such as information about dietary requirements or a request to reserve a disabled parking space for an event. We will only use this information for its intended purpose and delete it once we no longer need it.

      On what basis does KPMG process my personal data?

      We will only use personal data if we have a basis for doing so as required by law. The basis on which we process your personal data may vary and depends on the marketing activity and related activities. The following legal bases may apply:

      • Your consent: In some cases, we will ask you for your specific consent to process certain personal data, such as for sending direct messages or storing marketing cookies. You may withdraw your consent at any time in the manner indicated when you gave your consent, or by contacting KPMG at privacy@kpmg.nl.
      • Legitimate interest: We will process your personal data if this is necessary for our legitimate interest in relation to our business operations, their optimisation, and the achievement of our commercial objectives, provided that these interests are not overridden by yours. In a number of cases, we have a legitimate interest in processing your personal data for the purposes described in this statement under ‘Why do we use personal data?’ We may also use this basis besides or in addition to your consent.
      • Fulfilment of an agreement with you: Sometimes the processing of your personal data is necessary to fulfil our obligations based on an existing or future agreement with you. This agreement may be form-free. For example, in certain cases, registering for a marketing activity (e.g. an event) may be considered an agreement that requires us to process certain personal data about you in order to effect your participation.
      • Statutory obligation: It may be necessary to process your personal data in order to comply with a statutory obligation, for example if we have to disclose certain personal data at the request of a regulatory authority. In order to comply with our statutory duties, we also need to record that someone has objected to the processing of their personal data or has withdrawn their consent to do so.

      How do we obtain your personal data?

      We obtain personal data from you or from other sources. We only collect personal data in manners permitted by law.

      Through yourself
      In most cases we obtain your personal data direct from you, for example if you register for newsletters, direct messages or an event, or if you fill in a digital (evaluation) form or if you contact us yourself, for example by email.

      Through other sources
      We may also obtain your personal data from other sources and in other ways, such as in the following cases:

      • Your personal data is in our systems and databases, for example if you are the contact of a current or (former) client or supplier, or if you are an alumnus or otherwise have a relationship with KPMG. If you provide us with additional personal data, we will link it to the data we already have on you in our CRM system.
      • We receive personal data from third parties with which we cooperate in marketing, such as a marketing agency or a party with which we jointly organise an event.
      • We obtain personal data from public (online) sources, such as social media, business platforms and the trade register of the Dutch Chamber of Commerce (Kamer van Koophandel).
      • Personal data is collected or generated automatically, e.g. through the use of cookies, pixels and other techniques.

      With whom may your personal data be shared?

      Personal data may first of all be shared (internally) with KPMG staff or departments involved in the performance of our marketing activities. In addition, we may share personal data with other parties for our marketing activities. For example, other KPMG Member Firms, suppliers that provide (technical) support services in the context of marketing activities, such as IT services or postal and parcel delivery, marketing and advertising agencies or other partners with whom we cooperate, for example when we organise an event together. In such cases, where necessary, we will make appropriate arrangements for the protection of personal data before sharing it. Personal data will only be disclosed internally or externally for marketing purposes if this is necessary for our marketing activities. Our general KPMG Online Privacy Statement contains more information about sharing personal data with third parties and potential transfers of personal data to countries outside the EEA. 

      How long do we keep personal data?

      Personal data is kept for as long as necessary for the purpose for which it was collected. The exact period for which personal data is retained depends on the nature of the data and the specific context in which the personal data has been collected. Generally, a retention period of one year applies to personal data that we collect and record in our CRM system in relation to our marketing activities, unless your personal data is removed sooner, for example because you withdraw your consent, or if your personal data is no longer necessary for our marketing activities. Your personal data will be removed from the CRM system if it has not been actively updated or used by you or by KPMG for one year.

      The use of the L&D QR app implies the processing of personal data. KPMG believes it is important to safeguard the privacy and confidentiality of information entrusted to it. Therefore, we process your personal data carefully and securely. This Privacy statement applies to the L&D QR app. The application is meant to be used by both staff members and (external) trainers. In this Privacy statement you can read how we collect, use, share and protect personal data through the L&D QR app.

       

      Data controller

      KPMG Staffing & Facility Services B.V. is responsible for processing your personal data. It usually shares this respon­sibility with the KPMG entity that primarily determines the purpose and means of the data processing. KPMG Staffing & Facility Services B.V. is a subsidiary of KPMG N.V. and is registered in the commercial register in the Netherlands under number 34153861.

      Within the KPMG organisation, KPMG Staffing & Facility Services B.V. is charged as much as possible with compliance with privacy legislation, including the information obligation and the exercise of rights. If you have questions or com­plaints about the processing of your personal data, you can also contact KPMG Staffing & Facility Services B.V.

       

      Personal data

      The following personal data is processed when using the L&D QR app:

      • First and last name of the trainer;
      • First and last name of the attendee (KPMG employee);
      • Time of entry and departure of the attendee (KPMG employee);
      • Attended course.

       

      Purpose and legal basis

      The purpose of this personal data processing is to automate and digitalize the process of registering attendance at training courses and award PE points.

      Your personal data is not used for other purposes than those for which you initially provided this information. Excep­tions are if we have to comply with a statutory obligation, if you have given us permission to process your personal data also for a different purpose, or if further processing is permitted by privacy legislation.

      It is in the legitimate interest for KPMG to correctly register attendance to training courses and automate this process, and to provide an easy way to register for training courses to staff members. The privacy impact of the L&D QR app is limited as the personal data processing is limited to what is strictly necessary for the use of the L&D QR app.

       

      Security and retention

      KPMG has a security policy and procedures in place to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data.

      Your data will not be transferred to countries outside the European Union.

      We endeavour to strictly limit access to personal data to those who on behalf of KPMG must be involved in processing your personal data and those who are otherwise authorised to do so within the boundaries of the privacy legislation. Persons who have access to personal data are obliged to keep the information confidential. Where necessary, this has been contractually agreed upon.

      Trainers can only access the attendance list, including the first and last name of the attendees, for the training courses he or she will provide. These attendance lists will be removed in the L&D QR app within 24 hours after the training. This is the same for the (other) registration data: this will also be removed within one week after the training.

       

      Third parties

      For this data processing, KPMG may use the services of third parties, such as IT-services and other (administrative) support. Appropriate arrangements will be made with these parties in order to ensure a correct and secure data processing in compliance with applicable legislation.

       

      Questions or complaints

      You are legally entitled to request information about your personal data processed by KPMG. Furthermore you may request KPMG for access, or to transfer to you (data portability), rectify or erase, or to restrict the processing of your personal data. If you intent to exercise these rights, or in case of other questions or comments on the processing of your personal data, you may contact us at privacy@kpmg.nl. KPMG has a data protection officer, which can be contacted via FG@kpmg.nl.

      If you believe that the processing of your personal data infringes the applicable privacy legislation, you have the right to lodge a complaint with a supervisory authority in your country (in the Netherlands this is the Dutch Data Protection Authority).

      KPMG often uses tools and applications to digitalize our services offerings and our internal and external processes. In some cases you may use one of our tools or applications, for example if you attend our (web)events or conferences for which we use technology solutions such as webinar, survey and polling tools. If you work at one of our clients you may also come across our tools as part of our client services. For example, if you are asked to complete a questionnaire or assessment in one of our (web)applications or if you get access to tools we use to collaborate, to create a virtual data room and/or workspace, to manage projects, to visualize data or process flows or to provide certain (financial) insights in your employer’s processes or assets.

      In this privacy statement we inform you about how we process personal data if you use tools or applications that are used, provided or made accessible by or via KPMG (“KPMG Tools”).

      This privacy statement should be read in combination with the KPMG Online Privacy Statement, which statement includes additional information regarding our processing of personal data, such as with regard to the rights you have and our sharing of personal data with third parties.

      What (types of) personal data do we collect?

      The personal data that is being processed in the context of a KPMG Tool, depends on the specific tool or application. This may include the following (categories):

      • First name and last name
      • (business) (email) address
      • (business) telephone number
      • Information relating to a persons’ position such as company name, function title and department
      • Username
      • User account data
      • IP-address and other (automatically generated) technical data
      • Survey or poll responses
      • Information necessary for audit trails (e.g. access logs)
      • Digital signature
      • Chat- or conversation data
      • (profile) pictures or other visual material
      • Other information that is included in the tool or application

      In some cases, but only if this is permitted by law, the personal data that we collect may also include special categories of personal data (such as information about racial or ethnic origin, political opinions, religious and other beliefs, trade union membership, data about sexual orientation or health data) and data about alleged or proven criminal offences.

      We receive personal data directly from you, or via other sources, depending on the KPMG Tool and the specific use purposes of such KPMG Tool. In general, for KPMG Tools that we use within the scope of our client services, we receive personal data from our clients. We may also collect personal data ourselves in the course of the services, for example if we perform (marketing) research or conduct interviews. Furthermore, personal data may be collected via the KPMG Tool itself.

      We usually agree with our clients that if we need to process personal data in the context of our services, the client shall inform the data subjects about the processing of their personal data by KPMG.

      For what purposes do we use these personal data?

      It may be necessary to process personal data of users of KPMG Tools, such as personnel of our clients, persons that are otherwise related to our clients such as customers, and other persons related to KPMG, such as visitors of KPMG congresses or other KPMG (web)events. For example in order:

      • To provide services to clients, for example i) we provide the tool as a (SaaS-) product, ii) the KPMG Tool enables us to provide certain services, such as generating financial or corporate social responsibility insights, or iii) the KPMG Tool supports us when providing client services, such as data rooms or virtual workspaces;
      • To use technology solutions such as collaboration tools and project/process management tools, to enhance, automate and optimize our services and improve collaboration;
      • To create and maintain user accounts that are necessary to access and use KPMG Tools;
      • To use surveys, assessments and/or questionnaires within a client engagement and process the results thereof;
      • Conduct client satisfaction surveys;
      • Use surveys, polls and/or questionnaires for congresses or other KPMG (web)events;
      • Manage and operate the tool or application and protect and maintain our IT-systems;
      • Develop and improve KPMG Tools and our (associated) services;
      • Use cookies to enable certain functionalities and improve the functionality and quality of our technology solutions;
      • Process personal data for purposes that are compatible with the purpose the personal data is initially collected for;
      • Anonymize personal data to enable the use for other purposes such as knowledge sharing.

      What are the legal bases for our processing of personal data?

      We will only use personal data if we have a legal basis to do so. The legal basis to process your personal data depends on the KPMG Tool that you are using. The following legal bases may be applicable:

      • Performance of a contract: this applies when the processing of your personal data is necessary to perform our obligations under a contract with you (which can be form-free), or prior to entering into such contract. For example, if you subscribe for a KPMG (web)conference or KPMG event, this might be considered as concluding an agreement and to comply with our obligations under that agreement, we need to process certain personal data.
      • Legitimate interest: we process your personal data if this is in our legitimate interest to run and optimize our business, or in the legitimate interest of a third party such as our client, insofar this does not outweigh your interests. KPMG has, for example, a legitimate interest in processing personal data for the purposes as described above under “For what purposes do we use these personal data?”. In some cases, we do not (only) rely on our legitimate interest for the processing of personal data, but (also) ask your specific consent for the processing of your personal data, as described below.
      • Your consent: in some cases we ask for your consent to process (parts of) your personal data. We will only process your personal data in this way if you agree to us doing so. You may withdraw your consent at any time in the manner as described when providing your consent, or by contacting KPMG at privacy@kpmg.nl. This does not affect the lawfulness of the processing that took place before you withdrew your consent.

      Sharing and transfer of personal data

      In order to use KPMG Tools, it may be necessary to share or transfer your personal data to other member firms of the KPMG network and KPMG International, or to third party services providers. For example if it concerns a tool that we license from another KPMG member firm or a third party (SaaS)-supplier, or in case another KPMG member firm or third party supplier is engaged to provide services to us and you, such as hosting and supporting KPMG Tools. This may entail the transfer of certain personal data outside of the EEA to outside companies working with us or on our behalf for the purposes described in this statement and/or the general KPMG Online Privacy Statement. KPMG may also store personal information outside of the EEA. If we do this, your personal data will continue to be protected by means of contracts we have in place with the recipients of the personal data. In most cases we ensure that such recipients are, as a minimum, subject to standard contractual clauses as approved by the European Commission to ensure adequate protection of your personal data.

      It is possible that when using a KPMG Tool, a privacy statement from KPMG International, another KPMG member firm or a third party is shown. In some cases, these aforementioned parties may (also) process your personal data for their own purposes. This KPMG privacy statement does not relate to such use of personal data by other parties. We advise you to also read the privacy statements of KPMG International, other KPMG member firms or other third parties to make sure that you are duly informed about the processing of your personal data.

      How long do we retain personal data?

      The retention period for personal data depends on the nature of the data and the context in which the information is collected. Personal data is retained as long as necessary for the purpose they are collected for.

      With regards to KPMG Tools that are used within the scope of client services, data relating to user accounts and audit trails are usually retained for as long as an engagement for the service provision is active. That means that such personal data will generally be deleted within a short period after finalizing the respective engagement.

      Personal data that are processed within the scope of the services and that are part of the engagement file, are usually retained for a period of 7 or 10 years, depending on the kind of service.

      We may retain your personal data for a longer period if that is necessary in order to comply with legal, regulatory, internal company- or policy requirements or if this is necessary with regard to (preparations for) legal procedures or disputes.

      This privacy statement provides information about the processing of personal data by KPMG in the context of video surveillance at KPMG offices and surrounding premises in the Netherlands. This privacy statement should be read in addition to and in conjunction with the general KPMG Online Privacy Statement, which statement provides information about our processing of personal data, such as with regard to the sharing of personal data and the rights that you have. 

      What (types of) personal data do we process?

      In the context of video surveillance, we process the following types of personal data from individuals entering KPMG’s premises or those within the video’s coverage:

      • Video images.
      • Date and time of recording.
      • Location of recording.

      The processing of special categories of personal data through video surveillance is not intended and the video images will not be used to deduce such special categories of personal data or to make distinctions based on such personal data. Therefore, generally our video surveillance is not considered to be processing special categories of personal data, unless this is necessary and permitted by law. If there is a suspicion of unlawful behavior, video footage may be shared with authorities, in which case the personal data could potentially qualify as personal data related to alleged or proven criminal offenses. This will only occur if necessary and permitted by law. 

      For what purposes do we use these personal data?

      Video surveillance and the associated processing of personal data serves a.o. the following purposes:

      • Ensuring the safety and well-being of individuals.
      • Protecting KPMG’s premises from break-ins, theft and vandalism.
      • Monitoring assets and information.
      • Recording, investigating and handling of (potential) incidents.
      • Handling requests, complaints and disputes.
      • Establishing, exercising or defending our rights.
      • Meeting legal obligations and complying with government requests.

      What are the legal bases for our processing of personal data?

      The processing of personal data in the context of video surveillance is based on the legal basis ‘legitimate interest’. It is in the (legitimate) interest of KPMG and the persons visiting KPMG’s offices to process personal data for the purposes as described above under “For what purpose do we use these personal data”. To ensure that this interest is not outweighed by the interest of the individuals involved, KPMG has taken the necessary measures, such as only using video surveillance if necessary, camera placement is as privacy friendly and less intrusive as possible and access to the video images is restricted on a need-to-know basis. 

      How long do we retain personal data?

      Personal data collected through video surveillance is retained as long as necessary for the purpose they are collected for. Video images are usually retained for a period of 28 days after which term the images will be destroyed automatically. It might be necessary to retain personal data for a longer period for the handling of an incident, in order to comply with legal, regulatory, internal company- or policy requirements or if this is necessary with regard to (preparations for) legal procedures or disputes. In such case, personal data will be manually retained and destroyed as soon as retention is no longer necessary.

      In the context of our services we process personal data of employees of clients and other persons related to clients, such as contact persons that are employed at a client, board members, shareholders and supervisors and persons that are otherwise related to a client.
      This privacy statement describes how KPMG handles these personal data before start of the services, when performing the services and in other situations relating to our services. This privacy statement should be read in addition to and in conjunction with the general KPMG Online Privacy Statement, which statement provides additional information about our processing of personal data, such as with regard to the rights you have and the sharing of personal data with third parties.

      What (types of) personal data do we process?

      In the context of our services we may process various types of personal data, such as:

      • name;
      • date of birth;
      • address;
      • gender;
      • (business) email address and telephone number;
      • information relating to a persons’ position such as company name, function title and department and job history;
      • information that is available in public sources, such as the Chamber of Commerce;
      • information about shareholder positions/structure.

      For certain services additional financial data may be processed. This may also be the case if a natural person is client of KPMG.

      In some cases, and only if this is permitted by law, the personal data that we collect may also include special categories of personal data (such as information about racial or ethnic origin, political opinions, religious and other beliefs, trade union membership, data about sexual orientation or health data) and data about alleged or proven criminal offences. In some cases it may also be required to collect and retain the national identification number (in the Netherlands the Citizen Service Number (BSN)) or a (partly shielded) copy of an identification document.

      What are the legal bases for our processing of personal data?

      We will only use personal data if we have a legal basis to do so. The legal basis to process your personal data depends on the purpose of the processing. The following legal bases may be applicable:

      • Performance of a contract: this applies when the processing of your personal data is necessary to perform our obligations under a contract to which you are party, or prior to entering into such contract, for example if our client is a natural person.
      • Legal obligation: this applies when we are required to process your personal data in order to comply with a legal obligation, such as:
        • performing a know-your-client check or complying with other obligations under the Anti-Money Laundering and Anti-Terrorist Financing Act;
        • performing independence checks;
        • keeping records for tax purposes;
        • recording our activities in a file;
        • providing information to a governmental- or law enforcement agency (including supervisory authorities).
      • Legitimate interest: we process your personal data if this is in our legitimate interest to run and optimize our business, or in the legitimate interest of a third party such as our client, insofar this does not outweigh your interests. Our clients have a legitimate interest in receiving our services. KPMG has, for example, a legitimate interest in:
        • corresponding with (potential) clients regarding its services;
        • providing services;
        • keeping (financial) records;
        • conducting client satisfaction surveys;
        • protecting and maintaining IT-systems;
        • developing and improving services.
      • Your consent: in some cases we ask for your specific consent to process parts of your personal data. We will only process your personal data in this way if you agree to us doing so. You may withdraw your consent at any time in the manner as described when providing your consent, or by contacting KPMG at privacy@kpmg.nl.

      How do we process personal data before the start of the services?

      Prior to the start of our services, personal data may be processed for various reasons, such as:

      • during the proposition phase where we inform (potential) clients about our services, make proposals, communicate with clients and conclude an engagement;
      • verifying if a certain service can be provided to a (potential) client. We do this among other by checking if there are (potential) independence conflicts and by performing a know-your-client check.

      In the context of the know-your-client check, that KPMG performs on the basis of i.a. the Anti-Money Laundering and Anti-Terrorist Financing Act and internal policies, research is done on the client, the ‘ultimate beneficial owner’ of the client, so called ‘politically exposed persons’ that are related to a client, the representative of the client and the origin of capital. For the purposes of these checks it might also be necessary to request and keep a copy of the identification document, and to perform research in various (public) sources, which research may involve the processing of personal data and special categories of personal data.

      How do we process personal data when providing services?

      As part of our services, it may be necessary to process personal data of persons that are related to a client, such as persons that are employed at a client or that are registered in the customer database of a client. For example in order to:

      • audit the financial statements for e.g. companies within the health care industry, insurance companies or pension funds;
      • provide other accountancy related services;
      • carry out a forensic investigation on behalf of a client;
      • provide payroll services;
      • provide various consultancy services, such as with regard to the improvement of a client’s internal processes;
      • provide access to software and technical support and advice in that regard.

      In most cases, we receive the personal data that we process when providing our services from our clients. We may also collect personal data ourselves in the course of the services, for example if we perform marketing research or conduct interviews.

      We usually agree with our clients that if we need to process personal data in the context of our services, the client shall inform the data subjects about the processing of their personal data by KPMG.

      The personal data that we process depends on the specific context of the services. As a general rule, we try to limit the processing of personal as much as possible.

      Other processing of personal data

      Besides the personal data processing before and during our service, it may be necessary to process personal data from employees of clients and other persons related to the clients for other reasons, for example to:

      • prevent fraud or criminal activity and to safeguard and maintain our IT-systems;
      • comply with our business obligations;
      • perform quality checks in order to monitor the quality of our services;
      • anonymize personal data to enable the use for other purposes such as knowledge sharing;
      • monitor, analyze or benchmark our services;
      • comply with our obligations on the basis of law and (professional) regulations;
      • institute, substantiate or defend against a legal claim or other legal procedure.

      How long do we retain personal data?

      The retention period for personal data depends on the nature of the data and the context in which the information is collected. Personal data is retained as long as necessary for the purpose they are collected for. Personal data that is processed within the scope of the services and that are part of the engagement file is usually retained for a period of 7 or 10 years, depending on the kind of service. It might be necessary to retain personal data for a longer period in order to comply with legal, regulatory, internal company- or policy requirements or if this is necessary with regard to (preparations for) legal procedures or disputes.

      These Terms of Use (hereinafter referred to as “Terms”) state the terms under which you may use the KPMG L&D QR App (hereinafter referred to as “App”).

      The terms “You”, “Your” and “Yours” when used in these Terms means each specific user of the App. The terms “We”, “Us” and “KPMG” mean KPMG Staffing and Facilities Services B.V.

       

      1. Use of the App and its contents is limited to the purpose for which it has been established. You may use the App and its content only if you have been designated by KPMG as an authorized user of the App. You may not use the App for your own personal or private commercial purposes.

       

      2.      You must not:

      a. except as expressly permitted by these Terms, permit any third party to access or use the App (which includes not disclosing or sharing your user name or password or security token with any other person) or use it on behalf of any third party (which includes operating any form of facility on behalf of any third party or operating a software bureau or similar service);

      b. copy, translate, modify, adapt or create derivative works from the App and its contents;

      c. create Internet "links" to the App and its contents or "frame" or "mirror" the App and its contents on any other server or wireless or Internet-based device;

      d. attempt to discover or gain access to the source code for the App or reverse engineer, modify, decrypt, extract, disassemble or decompile the software it employs;

      e. attempt to interfere with the proper working of the App and, in particular, must not attempt to circumvent security, license control or other protection mechanisms, or tamper with, hack into or otherwise disrupt the App and its contents or any associated website, computer system, server, router or any other internet-connected device;

      f.  obscure, amend or remove any copyright notice, trade mark or other proprietary marking on, or visible during the operation or use of, the App and its contents;

      g. and shall not permit any other authorized user or other third party to do any of the foregoing.
       

      3. KPMG will provide You with the login codes, such as a user name and password, that enable access to the App and its content. In case you are an employee of KPMG you can log in to the App by using Your Windows Creden­tials. The login codes are personal, non-transferrable and secret.

       

      4. You guarantee that you will comply with these Terms and that You will use the login codes carefully. You will take all reasonable measures to prevent the login codes from becoming known to unauthorized persons and You will immediately notify KPMG if You discover any form of unauthorized use of the login codes.

       

      5. You acknowledge that all intellectual property rights in the App and its contents are owned by KPMG or its licen­sors. You acknowledge that you acquire no right or interest of any kind in or to the App and its contents.

       

      6. You acknowledge that content posted on the App is confidential and You agree to respect the confidentiality of such content.

       

      7. You acknowledge that KPMG may disclose any and all content on the App to the extent required to do so by applicable laws, legal process or regulatory authority.

       

      8. You acknowledge that access to the App may be suspended, limited, denied or disabled at any time and that content posted on the App may not be recoverable.

       

      9. KPMG reserves the right to terminate Your access to the App for any reason, including in the event KPMG becomes aware of any unauthorized use of the App or any breach of these Terms by You.

       

      10. KPMG does not guarantee that the use of the App will be uninterrupted or error-free and that errors or defects will be corrected.

       

      11. KPMG does not guarantee that the content that it provides through the App is complete, correct, or up-to-date.

       

      12. You acknowledge that, whilst KPMG has designed the App with information security in mind and has taken steps to safeguard the security of the App, KPMG cannot guarantee that the App is invulnerable to hacking or other unauthorized access by third parties. You also acknowledge that transmission of information over the Internet is not entirely secure and there is always the possibility of unauthorized interception by third parties.

       

      13. KPMG does not guarantee that (any content posted on) the App will be free from viruses and/or other code that may have contaminating or destructive elements. It is Your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy its particular requirements as to the safety and reliability of content it provides and accesses through the App. KPMG accepts no responsibility for the content of any third party websites and/or hyperlinks to which may be featured in the App.

       

      14. To the extent permitted by applicable law, in no event KPMG shall be liable to You for any damages whatsoever resulting from the use of the App and its contents. The aforementioned limitation of liability does not apply in the case of intent or willful recklessness on the part of KPMG’s executive staff.

       

      15. To the extent that KPMG processes any personal data, KPMG shall process such data in accordance with appli­cable law as set out in KPMG’s privacy policy which applies to the App.

       

      16. If You breach any of your obligations under these Terms and any claim is made or threatened against KPMG by a third party, You shall compensate KPMG, hold KPMG harmless and reimburse KPMG for and protect KPMG against, any loss, damage, expense or liability incurred by KPMG which results from or arises from or is connec­ted with any such breach and any such claim. If any payment is made by You under this clause You shall not seek recovery of that payment from KPMG at any time. In this clause “KPMG” includes each and all partners, members, directors, employees, agents of KPMG together with any entity controlled by or associated with KPMG.

          1. Collection and use of personal information

          1.1 What information we collect
          We obtain personal information about you if you choose to provide it — for example, to contact mailboxes or to register for certain services. In some cases, you will have previously provided your personal information to KPMG (if, for example, you are a former employee). We may use your personal information to construct or complete your profile, possibly in combination with information already available on you, so that we can offer services to you for example as part of our sales.

          If you choose to register or login to a KPMG website using a third party single sign-in service that authenticates your identity and connects your social media login information (e.g., LinkedIn, Google, or Twitter) with KPMG, we will collect any information or content needed for the registration or log-in that you have permitted the social media provider to share with us, such as your name and email address. Other information we collect will depend on the privacy settings you have set with your social media provider, so please review the privacy statement or policy of the applicable service.

          When you register or submit personal information to KPMG we will use this information in the manner outlined in this Privacy Statement and, if applicable, a specific privacy statement. Your personal information is not used for other purposes, unless we obtain your permission, or unless otherwise required or permitted by law or professional standards.           1.2 The legal grounds we have to use your personal information
          Privacy legislation, including the General Data Protection Regulation (GDPR), allows us to process personal information, so long as we have a ground under the law to do so. It also requires us to tell you what those grounds are. As a result, when we process your personal information, we will rely on one of the following processing conditions: 

          • Performance of a contract: this is when the processing of your personal information is necessary in order to perform our obligations under a contract; 
          • Legal obligation: this is when we are required to process your personal information in order to comply with a legal obligation, such as keeping records for tax purposes or providing information to a public body or law enforcement agency; 
          • Legitimate interests: we will process information about you where it is in our legitimate interest in running a lawful business to do so in order to further that business, so long as it doesn’t outweigh your interests; or
          • Your consent: in some cases, we will ask you for specific permission to process some of your personal information, and we will only process your personal information in this way if you agree to us doing so.           Examples of the ‘legitimate interests’ referred to above are:

          1.3 Automatic collection of personal information
          In some instances, KPMG and its service providers uses cookies, web beacons and other technologies to automatically collect certain types of information when you visit us online, as well as through emails that we may exchange. The collection of this information allows us to customize your online experience, improve the performance, usability and effectiveness of KPMG's online presence, and to measure the effectiveness of our marketing activities.

          1.3.1 IP addresses
          An IP address is a number assigned to your computer whenever you access the internet. It allows computers and servers to recognize and communicate with one another. IP addresses from which visitors appear to originate will be recorded for IT security and system diagnostic purposes. This information will also typically be used in aggregate form to conduct website trend and performance analysis.

          1.3.2 Cookies
          Cookies will typically be placed on your computer or internet-enabled device whenever you visit us online. This allows the site to remember your computer or device and serves a number of purposes.

          On some of our websites, a notification banner will appear allowing you to provide and manage your consent to use cookies (cookie banner).           On our website we also use conversion tracking through LinkedIn Insight Tag. LinkedIn Insight Tag is a tool provided by LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland. To enable this conversion tracking, the LinkedIn Insight Tag is integrated into our website and LinkedIn places a cookie on your device. LinkedIn learns that you have visited our website and your IP address is collected. Timestamps and events such as page views are also saved. This makes it possible for us to statistically evaluate the use of our website, so that we can continuously optimize our website.           To provide website visitors with more choice on how their data is collected by Google Analytics, Google have developed the Google Analytics Opt-out Browser Add-on. The add-on communicates with the Google Analytics JavaScript (ga.js) to indicate that information about the website visit should not be sent to Google Analytics. The Google Analytics Opt-out Browser Add-on does not prevent information from being sent to the website itself or to other web analytics services.

          1.3.4 Web beacons
          A web beacon is a small image file on a webpage that can be used to collect certain information from your computer, such as an IP address, the time the content was viewed, a browser type, and the existence of cookies previously set by the same server. KPMG only uses web beacons in accordance with applicable laws.

          KPMG or its service providers will use web beacons to track the effectiveness of third party websites that provide us with recruiting or marketing services or to gather aggregate visitor statistics and manage cookies.

          You have the option to render some web beacons unusable by rejecting their associated cookies. The web beacon may still record an anonymous visit from your IP address but cookie information will not be recorded.

          In some of our newsletters and other communications, we will monitor recipient actions such as email open rates through embedded links within the messages. We collect this information to gauge user interest and to enhance future user experiences.

          1.3.5 Location-based tools
          KPMG will collect and use the geographical location of your computer or mobile device. This location data is collected for the purpose of providing you with information regarding services which we believe may be of interest to you based on your geographic location, and to improve our location-based products and services.

          1.4 Social media widgets and applications
          KPMG websites will typically include functionality to enable sharing via third party social media applications, such as the Facebook Like button and Twitter widget. These social media applications will collect and use information regarding your use of KPMG websites (see details on 'Social Sharing' cookies above). Any personal information that you provide via such social media applications will often be collected and used by other members of that social media application and such interactions are governed by the privacy policies of the companies that provide the application. We do not have control over, or responsibility for, those companies or their use of your information. For more information please refer to the third party's privacy statement.

          In addition, KPMG websites may host blogs, forums, crowd-sourcing and other applications or services (collectively "social media features"). The purpose of social media features is to facilitate the sharing of knowledge and content. Any personal information that you provide on any KPMG social media feature will typically be shared with other users of that social media feature (unless otherwise stated at the point of collection), over whom we often have limited or no control.

          1.5 Children
          KPMG understands the importance of protecting children's privacy, especially in an online environment. In particular, our sites are not intentionally designed for or directed at children under the age of 16. It is our policy never to knowingly collect or maintain information about anyone under the age of 16, except as part of an engagement to provide professional services.

          2. Sharing and transfer of personal information

          2.1 Transfer within the network of KPMG firms
          We share information about you with other member firms of the KPMG network as part of international engagements, and with KPMG International Limited, its related entities and other member firms where required or desirable to meet our legal and regulatory obligations around the world. Other parts of the KPMG network are also used to provide services to us and you, for example hosting and supporting IT applications, provision of certain forms of insurance for member firms and its clients, performing client conflicts checks and Anti-Money Laundering checks, assisting with client engagement services and otherwise as required in order to continue to run KPMG’s business.

          2.2 Transfers to third parties
          We do not share personal information with third parties, except as necessary for our legitimate professional and business needs, to carry out your requests, and/or as required or permitted by law or professional standards. In addition, KPMG will transfer certain personal information outside of the EEA to outside companies working with us or on our behalf for the purposes described in this Privacy Statement and, if applicable, a specific privacy statement. KPMG may also store personal information outside of the EEA. If we do this your personal information will continue to be protected by means of contracts we have in place with those organizations outside the EEA, for example containing standard data protection clauses which are in a form approved by the European Commission.

          KPMG will not transfer the personal information you provide to any third parties for their own direct marketing use.

          3. Choices

          In general, you are not required to submit any personal information to KPMG, but we will require you to provide certain personal information in order for you to receive additional information about our services and events. KPMG will also ask for your permission for certain uses of your personal information, and you can agree to or decline those uses. If you opt-in for particular services or communications, such as an e-newsletter, you will be able to unsubscribe at any time by following the instructions included in each communication. If you decide to unsubscribe from a service or communication, we will try to remove your information promptly, although we may require additional information before we can process your request.

          4. Access

          If KPMG processes personal information about you, you have the following rights:

If we agree that we are obliged to provide personal information to you, we will provide it to you free of charge. If the information we hold about you is incorrect, you are entitled to ask us to correct any inaccuracies in the personal information. 
          • Object to processing: you have the right to object to us processing your personal information if we are not entitled to use it any more.
          • Other Rights: in addition, you may have rights to have your information deleted if we are keeping it too long, have its processing restricted in certain circumstances and/or to obtain copies of information we hold about you in electronic form.

          You can make a request or exercise these rights by contacting KPMG at privacy@kpmg.nl and we will make all reasonable and practical efforts to comply with your request, so long as it is consistent with applicable law and professional standards.

          5. Data security and integrity

          KPMG has reasonable security policies and procedures in place to protect personal information from unauthorized loss, misuse, alteration, or destruction. Despite KPMG's best efforts, however, security cannot be absolutely guaranteed against all threats. To the best of our ability, access to your personal information is limited to those who have a need to know. Those individuals who have access to the data are required to maintain the confidentiality of such information.

          We also make reasonable efforts to retain personal information only for so long i) as the information is necessary to comply with an individual's request, ii) as necessary to comply with legal, regulatory, internal business or policy requirements, or iii) until that person asks that the information be deleted. The period for which data is retained will depend on the specific nature and circumstances under which the information was collected.
