      Notice of Intention to make a proposal pursuant to the Bankruptcy and Insolvency Act ("BIA")


      On October 7, 2021, Tomavo Inc. ("Tomavo" or the "Debtor") filed a notice of intention to file a proposal pursuant to Section 50.4 (1) of the BIA and KPMG Inc. has consented to act as Trustee under the proposal.

      First Extension of Delay

      On November 8, 2021, Tomavo filed with the Court of Queen's Bench of New Brunswick (the "Court") a notice of motion seeking the extension of the stay period up to December 21, 2021. The hearing was held on November 25, 2021 at 10:00 am.

      On November 25, 2021, the Court issued an order extending the stay of proceedings until December 21, 2021.

      Bankruptcy

      On December 21, 2021, Tomavo filed a bankruptcy and KPMG Inc., was appointed as trustee of the estate of the bankrupt by the official receiver, as stipulated on the Certificate of Appointment.

      Employees / WEPP

      1. Please be advised that in the first weeks of January 2022, the Trustee will mail you:
        a. A pre-populated proof of claim to allow you to file your claim with the Trustee
        b. A letter detailing the process by which you can submit a claim to the Wage Earner Protection Program ("WEPP") and the details of the amounts owed to you by Tomavo Inc.
      2. The Trustee does not anticipate that any amount will be remitted to you in the bankruptcy, so you are encouraged to submit your WEPP claim once you have received the documentation mentioned in paragraph 1.
      3. Finally, please note that the process to receive money in the WEPP is in two (2) steps:

      Step 1 - You must complete and return to the Trustee your Proof of Claim (by email, mail or fax). All details will be indicated on the proof of claim
      Step 2 - You must apply for the WEPP through Service Canada (website or telephone). All details will be provided in the letter detailing the process for applying for the WEPP.
